SC RULING ON CON-ASS RESOLUTION EXPECTED

Constituent assembly or "con-ass" is one of the three modes in which the 1987 Constitution of the Philippines could be amended or revised. The other two modes are via People's Initiative and Constitutional Convention. The bicameral Philippine Congress (Senate and the House of Representatives) is in a Constituent assembly mode when they formally convene to propose amendments or revisions to the 1987 constitution; and under Article XVII of the Constitution of the Philippines, upon a vote of three-fourths of all its Members.
The Supreme Court’s junking of the petition seeking to nullify a resolution in the House of Representatives, calling for a constituent assembly even without the senate came as no surprise to lawmakers.
House members in favor of and against the Con-Ass resolution said they expected the High Court throughout the petitions filed by lawyers Oliver and Evangeline Lozano and Luis Biraogo for being premature. And the dismissal was legally anticipated.
The house leader said he believes the SC ruling was in accordance with the opinion of constitutionalist Fr. Joaquin Bernas that House Resolution 1109 “does not by itself convene Congress into a Con-ass”
There will be a justiciable issue only when Con-ass is actually convened and proposed specific amendments are made.
